Hoopline GM (the "Game") is provided by Víctor López Rodríguez ("we", "us"), an individual trader established in Spain, with tax identification number (NIF) 05712011F and domicile at Calle de Valencia 5, escalera 2, 3.º A, 28945 Fuenlabrada (Madrid), Spain. You can contact us at any time, free of charge, at hooplinegm@gmail.com. We are not registered in any commercial or public register, and the Game is not subject to any administrative authorisation.
These Terms govern your use of the Game on iOS and Android. They are available in the Game and at our website at any time, and you can save or print them. By creating an account or playing, you accept them.
Hoopline GM is for people aged 16 or over. When you create an account, the app asks for the month and year you were born; if you are under 16 you cannot continue. We do not keep that date, only whether you are under 18 and, if so, until when. That answer is your declaration; we do not verify your identity or age. If you are 16 or 17, the ads you see are not personalised. If we learn that an account belongs to someone under 16, we will close it.
You are responsible for your account and for keeping your sign-in secure. You may delete your account at any time from the Game (More → Delete account); deletion removes your team, leagues and progress and cannot be undone. Hoopline GM is an independent basketball management game. It is not affiliated with, endorsed, sponsored or licensed by any professional basketball league, team, players' association or player.
Real players are referenced by name together with publicly available statistics as part of the game's sports-related content and simulation mechanics. These references do not imply any endorsement, sponsorship, authorisation or affiliation. Statistics are compiled from third-party sources, may contain errors or delays, and are not official league data.
All teams, arenas, competitions, avatars and other game content are fictional or created by us. Any similarity between a fictional team and a real organisation is not intended to suggest a connection.
What is real and what is ours. Real: a player's name, his draft history and his sports statistics from real games. Generated by the Game: each player's rating and market value, everything that happens in your league and cups (results, box scores, standings, awards and records), and the value of anything bought or earned in the Game. The Game's ratings and values are our own estimates for gameplay, not assessments of any real person.
Team names. The names of teams created by users must be fictional. They may not coincide with the name of a real professional franchise or team, or use its distinctive names. We may refuse a team name that breaks this rule, or ask you to change it. Names of cities and places are allowed.
Shareable cards. Some features of the Game let you create an image (a "card") with information from your game, such as a season, an achievement or your career, including your username. Sharing is done through your device's operating system and the third-party apps you choose. We do not publish these cards, and we do not receive or store them. You decide whether and where to share a card, and you are responsible for that decision and for the information it contains. You must not use this feature to infringe the rights of others. Once shared, a card is subject to the terms and privacy policy of the platform where you share it.
Your content and our official channels. Where a feature of the Game lets you create content intended to be shared, you keep whatever rights you have in that content. To the extent necessary for us to display, reproduce or republish that content on our official channels, you grant us a non-exclusive, free licence limited to that purpose. Before we republish a specific card on our official channels, we will also ask for your express permission.
The Game has two virtual currencies. Coins are earned by playing and pay the in-game salary cap; they cannot be bought with money. Gems can be earned or bought and are used for energy refills and cosmetic items. Neither currency nor any virtual item is money, has any cash value, or can be exchanged for money or transferred outside the Game.
What you buy is a limited, personal, non-transferable licence to use the item in the Game, not ownership. Purchases are delivered immediately upon payment.
Right of withdrawal for gems. If you are a consumer, you normally have 14 days to withdraw from a contract concluded at a distance. Gems are digital content not supplied on a tangible medium and are delivered as soon as you pay. Before every paid purchase, the Game asks you, in a box that starts unticked, to request expressly the immediate supply of the gems and to acknowledge that, once supply has begun, you lose your right of withdrawal; the purchase does not go ahead unless you tick it. After the purchase we send you, by email, a confirmation of the contract that includes that request and acknowledgment. Having given them, and once supply has begun, you have no right of withdrawal (Article 103(m) of the Spanish consumer protection act, the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios, implementing Article 16(m) of Directive 2011/83/EU). We keep a record of each consent and confirmation for five years from the purchase, as our privacy policy explains.
Items bought with gems (energy refills and cosmetic items) are not purchases made with money; they are the use of gems you already have.
Your statutory rights are not affected. Digital content must conform to the contract, and if it does not you have the remedies the law gives you, including where the gems you paid for are not delivered. Payments are processed by Apple or Google, who also handle refund requests under their own policies; you may also write to us.
The optional Premium subscription is billed by Apple or Google, renews automatically until you cancel it in your store account, and can be cancelled at any time with effect at the end of the current period. What Premium includes, its price and its period are shown in the Game and in the store before you pay. It never makes a squad stronger.
Premium is a digital service. When you subscribe, the Game asks you, in a box that starts unticked, to request expressly that Premium start immediately, during the withdrawal period, and to acknowledge that if you withdraw after it has started you will pay the proportionate amount for the service already provided; the subscription does not go ahead unless you tick it. After the purchase we send you, by email, a confirmation of the contract that includes that request and acknowledgment. You may still withdraw within 14 days of subscribing; if you do, you will pay an amount proportionate to the part of the service already provided (Article 108.4 TRLGDCU). You can withdraw by requesting a refund from Apple or Google or by writing to us, using any clear statement.
The Game shows optional rewarded advertisements. Where required, you are asked for consent first and can change your choice in Settings.
You agree not to cheat, exploit bugs, automate play, interfere with the Game or its servers, reverse-engineer it except where the law allows, or use it for any unlawful purpose. We may suspend or close accounts that break these rules; where the breach is not serious we will warn you first.
The Game is provided as it is and as available. We may change, suspend or end features, rebalance the game economy, or reset a season, acting reasonably and without affecting items you have already paid for more than necessary. If these Terms change in a way that affects you, we will tell you in the Game before the change takes effect.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law — including liability for death or personal injury, for fraud or wilful misconduct, or for gross negligence — or any statutory rights or remedies available to consumers.
Subject to the foregoing, we will be liable only for losses that are reasonably foreseeable and directly attributable to our breach of these Terms, to the extent permitted by applicable law. We are not liable for losses caused by events outside our reasonable control, or for business losses: the Game is for personal, non-commercial use.
Nothing in these Terms affects the statutory guarantees and conformity rights applicable to digital content and digital services: for gems, two years from supply; for Premium, for as long as it is supplied.
These Terms are governed by Spanish law. If you are a consumer, this choice does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside.
If you are a consumer, you may bring proceedings against us in the courts of the place where you are domiciled or in the courts of Spain, and we may only bring proceedings against you in the courts of the place where you are domiciled.
If you have a complaint, please write to us first at hooplinegm@gmail.com; we will reply within 30 days. You may also contact the consumer authorities or an alternative dispute resolution body in your country. We do not currently participate in any alternative dispute resolution scheme.
